Terms of Service (AGB)
This English version is provided for convenience only. The German version of these Terms (AGB) is the legally binding one.
These Terms of Service (AGB) govern the use of the Nomado24 job-board platform, operated by Nomado24 UG (haftungsbeschränkt).
§ 1 Scope
- These Terms govern contracts for Nomado24 accounts and services. The specific service and pricing information in the offer and order process supplements them.
- The Terms are incorporated when the relevant contract is concluded. Simply visiting public pages does not constitute acceptance.
- Individual agreements take precedence. Different business terms of companies apply only if agreed with us.
§ 2 Description of Services
- Nomado24 is an online platform for location-independent and remote-friendly work.
- In particular, the platform enables:
- Companies to publish job advertisements
- Applicants to search for job openings and submit applications
- Communication between applicants and companies
- Browsing and booking coworking spaces
- Participation in a community forum for exchange between users
- Use of an AI-powered career assistant (AI Advisor) for general information purposes
- Bookings of coworking spaces may be subject to charges. Payment processing is handled by the payment service provider Stripe; its terms apply in addition.
- The AI advisor generates automated suggestions that may contain errors. They do not replace individual legal, tax or immigration advice. Check results before important decisions. Our liability is governed by section 6.
- Nomado24 provides the platform and is not a party to employment contracts between applicants and employers. No hiring outcome or application success is promised.
§ 2a Coworking Marketplace
- Through the coworking marketplace, Nomado24 brokers bookings of coworking offers. The contract for the coworking service is concluded directly between the user and the respective operator of the offer; Nomado24 does not become a party to that service. Payment is processed via the payment provider Stripe.
- The total price payable, including any applicable statutory VAT, is shown during the booking process before the booking is completed. Nomado24 may receive a commission or service fee from the operator for the brokerage; this does not create any additional cost for the booking user beyond the total price shown.
- Cancellation and refunds are governed by the operator's conditions displayed with the respective offer. Mandatory statutory rights of the user remain unaffected.
- The order in which coworking offers are displayed (ranking) follows, in the default "Recommended" sort, the relevance to the search query and the selected filters (including location, city, capacity and price) as well as the offer's rating and recency. Users can change the sorting themselves, for example by price or by distance from a chosen location. No preferential placement in exchange for payment (paid placement) takes place.
- Business users (operators) may address complaints relating to the coworking marketplace to the email address stated in the imprint. Nomado24 handles such complaints promptly and communicates the outcome to the operator.
§ 3 Registration and User Account
- Public job listings are accessible without registration. An account is needed for personal functions such as saved applications and messages.
- Complete and truthful information must be provided during registration.
- The user is obliged to keep their access credentials confidential and to protect them from unauthorized access.
- Each user may create only one user account.
- Transferring the user account to third parties is not permitted.
§ 4 User Obligations
4.1 General Obligations
- Users undertake not to publish any unlawful content
- Users undertake not to publish any content that violates common decency
- Users undertake not to upload copyrighted content without authorization
4.2 Obligations for Companies
- Job advertisements must be truthful and complete
- Discriminatory job advertisements are prohibited
- Companies must comply with data protection regulations when processing applicant data
4.3 Obligations for Applicants
- Application documents must be truthful
- Uploading malware or harmful files is prohibited
- Multiple applications for the same position via different accounts are not permitted
§ 5 Fees and Paid Services
The core functions of the Nomado24 platform (in particular job search, applications and use of the community forum) are free of charge for users. In addition, we offer optional paid services:
- Optional subscriptions have the services and total price including VAT shown before the paid order. Registration alone does not create a payment obligation.
- Monthly billed Pro subscriptions run indefinitely and can be cancelled at any time with effect at the end of the current billing period. The agreed price is due at the start of each period. Existing different plan agreements remain in place.
- Existing Pro search passes retain their agreed duration and end without renewal. This plan is no longer offered for new purchases.
- Existing Founding Member subscriptions retain their agreed terms. This plan is no longer offered for new purchases.
- Payments are processed through Stripe. Purchases through an app store additionally use the payment and management procedures shown before the order. Statutory rights remain unaffected.
- Consumer offers state the total price including VAT. Offers exclusively for businesses may state net prices plus specified VAT; the total is displayed before ordering.
Job listings for businesses
The paid direct listing is for businesses. Registration and drafts are free. Price, VAT and service scope are shown before ordering. Your paid order commissions publication of the specified listing; we confirm the order electronically. A listing may be reviewed for eligibility before publication. The agreed term begins on actual activation, ends without an automatic subscription and is recorded in the order. Paid promotion is recognisable as such. No particular number of applications or hiring outcome is owed. If a paid listing is ultimately not published, we refund the amount paid for the unprovided service. Statutory rights remain unaffected.
§ 5a Right of Withdrawal for Digital Services
- For contracts for digital services concluded online, consumers are generally entitled to a statutory 14-day right of withdrawal.
- We do not require you to waive your right of withdrawal in order to take out a paid subscription. The service may be provided immediately after the contract is concluded; your 14-day right of withdrawal remains unaffected.
- A timely withdrawal from a Nomado24 subscription receives a full refund. The withdrawal notice and public withdrawal function are linked in the footer. Ordinary cancellation instead concerns the end of the ongoing contract.
§ 6 Liability
- Our liability is unlimited for intent and gross negligence, injury to life, body or health, guarantees we have assumed and mandatory statutory liability.
- Otherwise, for ordinary negligence we are liable for breaches of essential contractual obligations that enable proper performance and on which you may normally rely. This liability is limited to foreseeable damage typical of the contract.
- Outside these cases, liability for ordinary negligence is excluded. The exceptions above also apply to our legal representatives and agents.
- Authors are responsible for the information they submit. Our own statutory duties to examine, inform and remedy remain unaffected.
- Agreed services remain owed. A particular hiring, application or commercial outcome is owed only if expressly agreed.
§ 7 Data Protection
Personal data is processed in accordance with ourPrivacy Policyand the applicable data protection regulations.
§ 8 Termination and Suspension
- Users may delete their account at any time without giving reasons.
- For unlawful content or breaches of contract we may take proportionate measures, such as removing content or temporarily restricting functions. Where permitted, we explain the grounds and scope and allow a response; urgent protective measures remain possible.
- Both parties retain the right to terminate for good cause. This does not exclude any required warning or opportunity to remedy. Complaints about measures can be submitted through the legal notice contact.
- After termination of the user relationship, personal data will be deleted in accordance with the Privacy Policy.
- Ordinary Pro cancellation is available in the account or without login through “Cancel contracts here”. The public form also accepts extraordinary grounds and requested termination dates. Receipt and outcome are confirmed; cancelling a subscription does not delete the account.
§ 9 Copyright and Usage Rights
- Where content is protected by copyright, the respective rights holders’ rights apply. Uses permitted by law remain allowed.
- You grant us the non-exclusive rights needed to store, display and transmit your content as requested by you. This does not make application documents available for public use.
- Further exploitation of others’ content requires a legal permission or the rights holder’s consent.
§ 10 Changes to these Terms
- New Terms apply to new contracts when incorporated.
- We agree changes to existing contracts expressly with you, particularly prices and main services.
- Silence does not constitute acceptance of contractual changes.
- Rejecting a change does not automatically end the existing contract. Statutory and agreed termination rights remain in place.
§ 11 Final Provisions
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers retain mandatory protections of their country of habitual residence where the law provides.
- Statutory rules on jurisdiction apply. Only for merchants, public-law legal entities or public-law special funds is Frankenthal agreed as the venue, where permitted.
- Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
